WILLFUL BLINDNESS AS A WAY OF PROVING INTENTIONAL DOLUS EVENTUALIS
Abstract
This work presents the willful blindness doctrine or, as it is also known, the "theory of deliberate blindness", presenting its concept and some of the criticisms raised by foreign doctrine. It then analyzes the institute of eventual intent, which is often equated with the willful blindness doctrine, presenting its main theories. In the end, it verifies whether both theories are equivalent, demonstrating whether the willful blindness doctrine can be applied to Brazilian criminal law as support for proving intent.
