Abstract

This article is dedicated to discussing the function of compliance in the practices of illicit practices committed by a partner and/or employee of a business company that, in a hidden way, for their own benefit or that of others, harms the business society causing civil, administrative and, mainly, liability criminal liability. This research is justified by the importance of the theme with bias in unfair competition for business companies, mainly because of the crime now being investigated having as agent a person without any kind of suspicion. The study proves to be important for the Law and, in particular, for the Criminal Law of the Company, given that this type of action occurs most of the time because there is no institutionalized compliance policy in society, leaving it at ease for the practice of such illegal acts people trusted by the business company who sometimes have access to privileged information and even industrial secrets. In this way, the results were verified in the importance of seeking to implement anti-corruption policies to protect the assets of the business society and punish the identified agents.
