O compliance como ferramenta de prevenção a desastres e crimes ambientais

Abstract

The climate emergency and sustainability are variables that can no longer be ignored by the economic order, as business activity has a socio-environmental duty to guarantee an ecologically balanced environment, today considered by the UN to be a human right. To achieve this objective, companies cannot limit themselves to acting to repair environmental damage, but must increasingly improve their risk management to ensure effective preventive action. In this context, environmental compliance emerges as an important tool for disaster prevention and also has repercussions in the criminal sphere, given the possibility of criminal liability for legal entities. This article aims to reflect on this scenario, without ignoring the absence of a regulatory framework on the subject in Brazil.
