Abstract

This work refers to misogyny and prejudice against women, which are still present in the structures of political power. Historically, women have not only been eclipsed in the race for legislative seats and executive branch positions, but also in the internal power structures of political parties. We examine an emblematic case that occurred in the Brazilian elections of 2020, for mayors and municipal council members. Its pioneering content is due to the fact that we examine for the first time a judgment by the Rio de Janeiro Municipal Electoral Tribunal in which there was discussion of the concept developed by legal scholars of political gender violence, a theory argued by the Electoral Prosecution Service in defense of a female candidate
for mayor, who was victimized by hateful attacks aimed at her sexual intimacy.
