Abstract

The article addresses criminal procedure, freedom of expression, the right to inform and receive information, and the necessity of these elements in a democracy. It also examines witness statements under oath, the role of journalist witnesses, the definition of a journalist, and the confidentiality of journalistic sources. It does not include issues related to concealment, participation in the crime under investigation, or knowledge of facts that would prevent the source’s identity from being
revealed. Finally, it discusses the importance and necessity of respecting sources in a democracy, along with exceptions. The article also references the jurisprudence of the Inter-American Court, the European Court, and the United States Supreme Court.
