Abstract: The objective of this work is to analyze the theory of ethical-social restrictions on the right to self-defense. To this end, a non-exhaustive exploration of the contributions of legal-criminal dogmatics on the ethical-social restrictions to the right of self-defense and the reconstruction of its place in the plane of the foundations and conceptual structuring of self-defense will be carried out. The journey begins with a presentation of the theories underlying self-defense, placing the dualist model as a ground for affirming the problem of ethical-social restrictions. Next, the conceptual structure of self-defense is presented, which is followed by an analysis of the course of treatment of ethical-social restrictions on self-defense in German criminal dogmatics. Finally, the reception of the theory of ethical-social restrictions on self-defense by Brazilian legal-criminal dogmatics is analyzed, with the problematization of the methodological paths of substantiation of this theoretical construction in the Brazilian legal system.
